Terms of Use

1. The agreement

These Terms of Use ("Terms") are a legal agreement between you and 88741.INC ("88741", "we", "us") covering your use of this website and of our games, applications and related services (together, the "Services").

By downloading, installing or playing one of our games, or by using this website, you agree to these Terms. If you do not agree, please do not use the Services. You should also read our Privacy Policy, which explains how we handle information.

2. Who may play

Our games are intended for players of all ages. If you are under the age of digital consent in your country, you should have the permission of a parent or guardian before making any purchase. Parents and guardians are responsible for the use of the Services by the children in their care, including any purchases made through their Apple ID.

3. Your licence

Subject to these Terms, we grant you a personal, non-exclusive, non-transferable, revocable licence to download, install and play our games on devices you own or control, for your own non-commercial entertainment.

Your purchase, where there is one, buys this licence — not ownership of the software. The licence begins when the download completes and continues until it is terminated under section 11.

4. What you may not do

You agree not to:

• Copy, distribute, sell, rent, lease, lend or sublicense the Services or any part of them.
• Reverse engineer, decompile or disassemble the software, except to the extent that applicable law expressly permits it and that right cannot be waived.
• Modify, translate or create derivative works from the Services.
• Remove, obscure or alter any copyright, trademark or other proprietary notice.
• Use cheats, automation software, bots, hacks or unauthorised third-party tools that give you an unfair advantage or interfere with the operation of the Services.
• Exploit the Services for any commercial purpose, or use them in a way that infringes the rights of anyone else.
• Attempt to gain unauthorised access to any system, or interfere with the availability of the Services for other players.
• Use the Services in violation of any applicable law or regulation.

Our games are single-player experiences with no leaderboards that affect other players, so most of this is common sense. We mention it because agreements need to say it.

5. Purchases & refunds

Sunny Hollow: Camp Home is free to try. A single in-app purchase unlocks the full game permanently. All purchases are made through the App Store and are subject to Apple's terms as well as these.

• Prices are shown in the App Store before you confirm, and may include applicable taxes.
• All purchases are processed by Apple. We never see or store your payment details.
• The unlock is tied to your Apple ID and can be restored free of charge at any time from the in-game Settings screen.
• Refunds are handled by Apple under its own policy, via reportaproblem.apple.com.

6. Updates & availability

We may update our games from time to time — to fix bugs, add content, or change balance. Updates are delivered through the App Store and are governed by these Terms.

We do our best to keep the Services available, but we do not promise uninterrupted operation. We may modify, suspend or discontinue any part of the Services at any time. If we ever withdraw a game entirely, we will give reasonable advance notice where we can.

Your save data. Your progress is stored on your device and, if you enable it, in your iCloud account. We strongly recommend enabling iCloud sync. We are not responsible for save data lost through device failure, deletion of the app, or a disabled iCloud account.

7. Apple-specific terms

Because you obtained our games through the App Store, the following also applies:

• These Terms are between you and 88741.INC only, not with Apple. Apple is not responsible for the Services or their content.
• You must use the Services only on an Apple-branded device that you own or control, and only as permitted by the App Store Terms of Service and the usage rules in your device settings.
• Apple has no obligation to provide maintenance or support for the Services. Any support enquiries should come to us.
• Apple is not responsible for any product liability, consumer protection, or regulatory claims relating to the Services.
• Apple is a third-party beneficiary of these Terms and may enforce them against you.
• In the event of any failure of a game to conform to an applicable warranty, you may notify Apple and Apple will refund the purchase price where its policy provides. To the maximum extent permitted by law, Apple has no other warranty obligation.

8. Intellectual property

The Services — including the software, artwork, characters, music, sound, writing, trade dress and the "88741.INC", "Sunny Hollow" and "Camp Home" marks — are owned by us or our licensors and are protected by copyright, trademark and other laws.

We grant you no rights in our intellectual property other than the limited licence in section 3. You may not use our marks, logos or artwork without our written permission, except that streaming, video and review use of our games is welcome and needs no approval — attribution is appreciated but not required.

If you send us feedback, suggestions or ideas, you agree that we may use them freely and without obligation or compensation to you.

9. Disclaimers

To the maximum extent permitted by applicable law, the Services are provided "as is" and "as available", without warranties of any kind, whether express, implied or statutory. We do not warrant that the Services will be uninterrupted, error-free, secure, or free from data loss.

Some jurisdictions do not allow the exclusion of implied warranties, so some of the above may not apply to you. In that case, the exclusions apply only to the extent permitted.

10. Limitation of liability

To the maximum extent permitted by applicable law, 88741.INC will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data or goodwill, arising out of or in connection with your use of the Services.

Our total aggregate liability for any claim relating to the Services is limited to the greater of (a) the amount you paid us for the game giving rise to the claim, or (b) one hundred United States dollars (US$100).

Nothing in these Terms limits liability that cannot be limited by law, including liability for death or personal injury caused by negligence, or for fraud.

11. Termination

These Terms remain in effect until terminated. You may stop using the Services at any time by deleting the app. We may suspend or terminate your licence if you materially breach these Terms.

On termination, your licence ends and you must stop using and delete all copies of the software. Sections 8 through 13 survive termination.

12. Governing law

These Terms are governed by the laws of the jurisdiction in which 88741.INC is registered, excluding its conflict-of-laws rules and the United Nations Convention on Contracts for the International Sale of Goods.

Where local consumer protection law in your country of residence gives you rights that cannot be waived by contract, those rights are unaffected. Nothing in these Terms removes any statutory right you have as a consumer.

13. Changes

We may update these Terms occasionally. When we do, we will change the "Last updated" date at the top and publish the new version at this URL. If a change is material, we will take reasonable steps to tell you — for example, in an update note in the game.

Continuing to use the Services after a change takes effect means you accept the updated Terms. If you do not accept them, please stop using the Services.
